18 And when men strive together and one smites the other with a stone or with his fist and he does not die but is confined to his bed, 19 if he rises again and walks about outside with his staff, then he who smote him shall be innocent. He only pays for lost time and sees to it that he is completely healed. – Exodus 21:18 – 19
If two people physically strike one another and one is injured to the point he is unable to work or take care of his family, but does not die then the one causing the injury will ensure the injured man’s lost wages and medical bills are paid. Notice it does NOT say “the one who started the fight pays”, so this applies to both individuals in the conflict regardless of who started it. The one causing the injury is not “innocent” of hurting someone which is why he must pay for the medical attention and lost wages, but he is innocent of murder.
